Legal Question in Personal Injury in Ohio

Am I responsible for a childs injury on my property if I am not home at the time

We own a skateboard ramp that is located on our property, next to our garage when not in use. When I leave my home at times, kids are using it. Am I responsible for any injury that may occur? Should I let them use it when I am at home without thier parents permission?

The law in ohio on attractive nuisance recently changed and could create liability for you. Since this is a dangerous activity, the parents of the children should consent to the use of the ramp and as long as it is maintained in a safe condition any injury that takes place should not result in liability to you. However if you permit children under the age of 13 to use the ramp, especially without adult supervision you could be held liable. The general rule of thumb should be if they are going to use it have an adult present and if any rough play takes place stop it and report it to the parents. Since this is a recreational activity you have a much lower likelihood of liability but anything can happen and you can be sued even if the law would not create any duty on your part so be careful.
