30 day notice

i have a tenant who i gave her lease to 6 days ago. when i asked for it after 3 days she had not signed it yet... then 3 days after that i asked for it again and yet again she has not signed it. i want to serve her with a 30 day notice to vacate. do i need to get these papers from the court or can i type them up myself?

Dear Inquirer: You may prepare and serve a Three (3) Day Notice to Vacate the premises. (Not 30 days). Then proceed with the formal filing of the Complaint in the local Court having jurisdiction, for heasring and Order.

Here's an example of the 3 day Notice:

NOTICE TO LEAVE PREMISES

Sir and Madam: I wish you to LEAVE the following described premise, now in your occupancy as Tenant, situated in the City of ________________________, and State of: ____________________, and known as:

(Address) ____________________________________________________ Apt.:___________________

City: ___________________________________ State: ______________ Zip: _________________,

Together with the LOT OF LAND on which said apartment and premises is/are situated. The reason(s) for eviction is/are:

1. Failure and refusal to pay rent timely,

2. Failure to clean and maintain said premises, apartment and property free of trash, debris, or to maintain a a clean, sanitary and safe condition, without debris or other personal property causing an unreasonable danger and risk of harm , and

3. Violations of applicable Owner Rules and Regulations and City ordinances applicable to tenants� property use, health, safety and sanitary standards, maintenance and conditions.

Your compliance with this Notice within three (3) days after its service, will prevent any legal measures being taken by the Owner against you, in order to obtain possession under the law.

YOU ARE BEING ASKED TO LEAVE THE PREMISES. IF YOU DO NOT LEAVE, AN EVICTION ACTION MAY BE INITIATED AGAINST YOU. IF YOU ARE IN DOUBT REGARDING YOUR LEGAL RIGHTS AND OBLIGATIONS AS A TENANT, IT IS RECOMMENDED THAT YOU SEEK LEGAL ASSISTANCE.
