Abandoned mobile home
I advertised in local paper to give away mobile home requesting only that it be moved immediately. I own the land and gave empty, unoccupied mobile home to person who put his wheels and welded my hitch on it. I transferred title to him that day because his intention was to move it from the site the following morning. It is now going on 30 days from when I titled it to him. No communication has been made since that day. I have plans for the property and am at a standstill because the mh is in the way. A local magistrate here in WV said I should seek advice of attorney. The mobile home was a ''gift'' to him. I even paid to have the title transferred. I am also afraid of it tipping. It is now leaning because of how he has it on blocks on bare ground. It is not stable. I have left several messages with his relative and one at his job just to give him my name and number. He has not responded. I have a photocopy of the transferred title now in his name. I also have a photocopy of his drivers licence and an original notorized affidavit of transfer of ownership without consideration. I do not have any type of contract with him. I never rented to him. I feel like he has abandoned the mh but don't know what I can do......

Dear Inquirer: Your present remedy appears to be to notify the purchaser by certified mail, Return Receipt Requested, or by FedX overnight mail (more costly), that his mobile home, if not removed from the present site within 3 days, will be considered a continuing trespass against your real property, and subject to dialy damages of $___/day, plus legal expenses.
You may also inform the purchaser/trespasser that unless removed from your site, you will have the mbile home removed, impounded and held for all costs of removal, and damages, offsite, with daily storage charges, and will seek apropriate legal remedies, etc.
