Legal Question in Real Estate Law in Ohio
Breach of contract on New Home Build
We are in contract for the purchase of a new home being built. The purchase agreement states that the home will be complete on our before July 31st, 2003. It looks as if that is not going to happen due the the builder dragging their feet. If this happens and the house is not complete what legal options do we have besides just walking out of the deal? We have our present home already rented to tenants. And we only have a week to be moved into our new home. Do we have good grounds to sue for the losses? What rights do we have, besides just walking away from the deal? We have to have a place to live.
Thanks!

Re: Breach of contract on New Home Build
Every builder contract is different. Your rights will be governed by the contract. You should see an attorney and let them review the contract. Most likely, you will want to negotiate something with your builder to cover some of your out-of-pocket expenses.
