Legal Question in Real Estate Law in Ohio

Closing on a home

My boyfriend and I closed on a home yesterday. We are not married to each other yet, and are still going through divorces. At the closing they advised us for the first time that our spouses have to sign papers stating that they are aware of the mortgage but will not be held responsible. My spouse went and signed but his spouse will not sign. Therefore we will have to back out of our home contract and run the risk of being sued by the sellers. Is there anything we can do??? Please help

Re: Closing on a home

You cannot force the soon to be former spouse to sign anything. Your real estate agent should have recognized this issue and sent you to an attorney for proper advice. The only possible good news is, if your contract has a financing contingency, your contract may be terminated.

Have you considered renting from the Seller until the divorces are final?
