Legal Question in Real Estate Law in Ohio

Condominium

My sister lives in a condo and there is a person who resides upstairs over her. First of all in the contract, it calls for 'no children' and then it says they are not to run businesses out of the building, she has children and she runs a day care service out of her condo. These two things I really don't take issue with. But my concern is sleep. At night when I come home,(9:30 -10:00pm), they still have a lot of bumping and running and loud noises which continue way into the night (around midnight they may begin to settle down). My sister talked to the woman and her live-in friend; she talked to the condo people, she even have called the police and nothing is being done. She has a health condition which demands that she get rest and she is unable to do so under the forestated conditions happening over her head. What recourse is open to her. I am not trying to make an enemy only obtain what I think is rightfully hers -- Peace and tranquility in her own home. Please tell us what can be done.

The easiest thing is to move. If that is not a possibility, you can call the zoning board or the building department and turn them in for running a business in a residential area.
