Legal Question in Real Estate Law in Ohio

Demand for reimbursement

We received a letter demanding reimbursement for repairs for a water line as well as a demand to pay for basement waterproofing. They state that they feel we did not disclose that the main line was cracked and that there was water problems in the basement. We lived in the home for 10 years and did not have any problems with the conditions they are describing. What should we do?

Re: Demand for reimbursement

Dear Inquirers: Clearly, you are neither liable nor responsible for any condition or defect of which you were not aware prior to sale of your house.

However, the purchasers may be able to show you had, at least, constructive notice by reason of excessive water usage and billings over any period of time prior to transfer of record.

Please contact an attorney to assist and advise you, since you may well have a truly valid defense and no obligation or liability.

Good luck.

Sincerely, J. Norman Stark, Cleveland, Ohio.
