Disclosure

I bought a house from a private seller in dec 99. The seller told me that the basement didnt leak. My inspector told my that the basement was freshly painted. The basement leaks in 5 places. I have 5 witnesses that heard them tell me that the basement does not leak and it never has.Every time it rains it leaks.My inspector stated that there was mold and mildew in basement.It is going to cost me at least 5000 dollars to fix.Do i have the right to sue the seller for hiding and not disclosing the leaky basement.Please tell me where i can get info.Thank you

There MAY be a cause of action against the seller. One has to show a hidden defect. The fact that the wall was recently painted will help your case. One should also look to the real estate disclosure form. There are tough case as it is basically caveat emptor(let the buyer beware), but they are not impossible cases.
