Legal Question in Real Estate Law in Ohio

ending a real estate contract.

Me and my wife are wanting to end a contract with a real estate agent that is selling our house. The reasons are numerous but mostly because she is a liar and lazy. We've asked about moving to another agent in the same company but she said that she refuses to let us go. We are more than willing to pay her for her expenses just so we can get away from her. Is there anything we can do to get out of it? The agency is ReMax

Dear Disappointed Sellers:

You have every right to terminate your contract with your real estate agent, for just cause. You must do it in writing and state that you are displeased with his/her efforts and representation and unless she consents, in writing, to immediately cancel your listing, without any charge, you will immediately contact the Ohio State Real Estate Commission to file a complaint and charge, or have your Attorney do so. Tell her that.

I would also suggest you contact the manager of the ReMax office to complain and state the same, suggesting you may turn this over to your Attorney for appropriate action. That'll get results. If not, don't back down, insist on terminating your sales listing, and find another realtor, or do it yourself, for a lot less in fees. But, retain an Attorney to assist and represent you before you sign anything else, or agree to any terms.
