Legal Question in Real Estate Law in Ohio

estate property nursing home resident

We are interested in purchasing commercial property owned by a resident of a nursing home. We were told we cannot use the land contract option because of this. Why? Can't a legal document be designed to help all parties involved? This is a win win situation for everyone. Since this is her estate and she is still alive, shouldn't she be able to do as she chooses? Otherwise she may never sell. Help!!

You could probably use a land contract to purchase the commercial building. The problem is that there may be medicaid implications. It may be too late to transfer the property in order to avoid transfering the building free of medicaid. One would have to look at the entire situation to see what options are available.
