Yes, by all means you may immediately notify this "squatter" to move ASAP, using the evicrtion procedure available in your Municipal court having jurisdiction - meaning the municipality in which your real estate is located. If no municipal court jurisdiction is available or applicable, use the County Court for procedure and filing. Serve the three-day notice, etc. according to the local rules of Court, and proceed accordingly with the First Cause and Second Cause, to recover the reasonable value of rent due you, including the cost to repair any damage caused to your property by their use (or abuse).
