I am attempting to move into an apartment with my boyfriend. I am paying half of the rent and we will share things equally as room mates. I will be replacing his former room mate who went for several months without paying rent or bills. He has recently paid back some of this money but is not paying the rent for this month. The landlord never made them sign a lease. This person has no documentation that he lives there and now he won't move his things out. We have moved some of his things into the basement to make room for my things. This person has threatened to take us to court for touching his belongings. Is this really illegal? Can't we move his belongings if he isn't paying to live there?

Technically, in order to get rid of his stuff you will need to file an eviction against the former room mate. In the interim you can place his belongings in a safe place. However, if you "touch" the stuff, you run the risk of saying that he lost a valuable asset and that you took it and are responsible for it.
