Legal Question in Real Estate Law in Ohio
Gas Bill on Property Sold years ago
In 2005, I sold a duplex in Cleveland Heights, OH and moved to Florida. I had a landlord agreement with Dominion Gas company that the gas would be put in my name rather than be shut off when there wasn't a tenant living there. I thought I had submitted the form to get this landlord agreement taken out of my name and I have a copy of the letter that I faxed in. I have been contacted that I owe $877 for gas used Nov. 2007 - Jan. 2008. Is this my responsibility? I have since made sure that my name has been removed from all accounts.

Re: Gas Bill on Property Sold years ago
Dear Inquirer, You should have had an Attorney to assist you, to cancel your responsibility and liability for this gas utility account, at least as of the date of sale of the property.
You may assert that your non-ownership of the title to the real property at the time of gas consumption was not your use, and should be charged to the then current owner.
Check your Real Property Sales Agreement, it may provide for such transferred responsibility for utilities.
Contact and retain experienced Counsel.
Good luck.
Sincerely, J. Norman Stark
