Legal Question in Real Estate Law in Ohio
Would like to install a fence beyond our property.
would like to install a fence around our property and also about six feet of property next to us, its a full size lot (approx 45x175)and is used as a driveway only.we belive the church is going say yes about installing the fence but some legal questions have come up, what if someone gets hurt,insurance issues? and thay don't want to cut the city lot into two properties,are there forms we can get or sign to release the church? please help us answer these questions, the church and our family are friends and would like to remain friends we just want to make our home look a little better and the fence would cut down a lot of people walking on church and our property at night. thanks you for your help. The Church could grant an easement to you and put stipulations in there about maintenance, insurance, liability, etc. Ultimately, the property owner would get named in a suit if there was an injury and then contractually, they would come after you perhaps. You need to go see a real estate attorney.
