Land Contract
I am a first time home buyer. I am in a land contract sort of I guess I have found out that the people we are in contract with have been lieing to my wife and I. They told us that the home was deeded as real estate and we have since found out that the home is clasified as a mobile home we found this out via public record at the court house also we have found out that there is no septic tank or areation sytem for the property and that there is seriouse foundation problems all of witch they neglected to imform us of they refused to let us file the land contract with the hall of records It seems like all they were interested in was taking our $15000 down payment We have brought up these problems on many occations to them. So my question is do I have any legal rights when it comes to this matter? and If so. Is it possible to get our innitial down payment back? My wife and I live on a fixxed monthly income as we are both disabled we did ask a lot of questions from them including about the septic and they said to us that there was a newer septic sytem put in aproximatly 4 years ago witch was a bold face lie.

Lying about important aspects of a deal, in order to get the other party to sign a contract and to pay money, constitutes fraud. The facts, as you described them, should permit you to defend a suit by the other party (if you stop paying and they try to foreclose) or should support your filing suit against them for damages based on fraud.
