Late rent payment - eviction

A friend paid his rent (lease) 3 days late and was informed by the landlord to be out in three days and took the rent payment. These people have two small children and one on the way. How long does the tenant have to relocate?

Time to get out after eviction

From the time the landlord gives the notice,there generally is a month to six weeks beforethe tenant will be put out of the house bythe bailiff or sheriff.

First, the landlord must bring an eviction action(forcible entry and detainer) in a municipalor county court. In this case, I should think such an action would be dismissed or, at the most,the tenant would be required to pay late charges.

Your friend's best bet is to hire an attorneyand fight the eviction.
