Legal Question in Real Estate Law in Ohio

Legal right to ownership of found animal.

6-7 week old kitten followed daughter home. No flyers posted. After 3 weeks, took kitten to vet for shots and checkup with the intent of keeping the kitten. Cost $64.00. After 1 month someone has come forward claiming kitten is part of a litter where two kittens had escaped. What rights do I have? If I have to give up kitten, can I be reimbursed for vet costs?

Re: Legal right to ownership of found animal.

You have no legal right to keep the animal, no more so than if you had found a lost wallet. However, you are entitled to get your $64 back under a theory of law called "unjust enrichment." This simply means that you spent money in a way that saved someone else from having to pay a required expense. Therefore, you are entitled to the $64 back. Small claims court may be your best chance of recovery. Good luck.
