is a mortgage illegal if it is not signed in our presence?

Your question does not give many facts. Usually the borrowers/homebuyers sign the mortgage at a closing, and a corporate officer signs later for the lender. As long as all the signatures appear, are not forgeries, are not made under duress, etc, the arrangement you suggest would be legal.
