is a mortgage illegal if it is not signed in our presence?

Your question does not give many facts. Usually the borrowers/homebuyers sign the mortgage at a closing, and a corporate officer signs later for the lender. As long as all the signatures appear, are not forgeries, are not made under duress, etc, the arrangement you suggest would be legal. If you have serious doubts or more facts, you should consult a local attorney who handles real estate matters.
