Legal Question in Real Estate Law in Ohio

Non-Compliant Septic System

Is it legal to sell a home in rural Ohio with a septic system that doesn't comply with current codes? In other words, I purchased a home about 7 months ago that I'm now selling. The prospective buyer ordered an inspection of the septic system, and now the county has deemed it a health hazard and is forcing me to install a new septic system at considerable expense. Obviously, the system was not in compliance prior to my purchase of the property. Do I have any recourse from the seller or even my realtor?

Re: Non-Compliant Septic System

The rule in Ohio is generally buyer beware. You should have had an inspection of the septic system. If you did not, I would venture that you have no recourse unless a specific statement was made that the system was okay.
