Partition Action
We are a family of five who have been deeded property and we wish to sell and one family member refuses to sign listing agreement to sell. Can we go for Partition Action and can he be made to pay the legal expenses for the suit against him?

yes, you could file a partition action, but what wuold four fifths of the property be worth. You may want to try to buy the lone heir out.
