property deed transfer
My mother and father both own the their home which has an existing mortgage. The deed is in both of their names. My father died recently and there is not a TOD on the deed. Can my mother have the deed put in her name without probate?

If the deed does not provide a right of survivorship, your mother will have to get a court order to transfer your father's half interest to her. There is a short form procedure to do this.
