Legal Question in Real Estate Law in Ohio
when you purchase a property on land contract. when the property is paid in full who is responsible for the property being survey to inform you of your property line
1 Answer from Attorneys
Dear Inquirer: Your initial Land Contract (agreement) should have contained a complete, written legal description, with parcel numbers, etc. and a copy of the graphic survey, if any was ever made. At least the legal description of the real property should provide you with a good description and physical location of the property lines.
The County Recorder's office can provide you with a graphic description (plat map) of your property, which should show the shape, size, dimensions along each property line, etc.
If, however, you require a Surveyor or Engineering Field survey, with pins placed, monuments and elevations noted, etc., as the purchaser, you may be entitled to a detailed survey from the Seller, provided that is included in your Land Contract documents.
If in doubt as to your rights and best interests, consult an experienced real estate Attorney.
Good luck. Sincerely, J. Norman Stark, Cleveland, Ohio.
