Legal Question in Real Estate Law in Ohio

We purchased a home and upon inspection were told there was a little mold in the crawl space that we could clean up ourselves so we went ahead with the purchase based on this inspection. Two weeks after moving in we found that the mold was more extensive than the inspector stated and have left the home since we have a 5 month old infant and are facing foreclosure since we are not paying for a home we can not live in. We are wondering what can be on our behalf against the previous home owners or the mortage company. Thank you.

Dear Inquirer: You may have to assert your rights in an action (lawsuit) against the sellers of your house, for concealment, i.e., failure to disclose the extent of the mold infestation. Such disclosure, in writing, is mandatory in Ohio, under the Sales Disclosure Act. Seek the advice of an experienced Attorney to assist and advise you. Good luck. Sincerely, J. norman Stark, Cleveland, OH.
