My fiance and I are buying our first home. We are both listed on the deed. Our title agency wants us to tell them if we want survivorship language included. Is this a good option? What happens if we do not get that language included?

Adding the language with right of surivorship means that if one of you passes away the property passes to the surviving owner automatically.

If you do not have the language with right of survivorship then you hold the property as joint tenants and if someone passes away one-half of the property would pass according to the deceased owners will.

You should consult with an estate planning attorney who can tell you which option would be the best depending on the facts and circumstances of your particular situation.
