Real Estate Land Purchase

My husband and I made an offer on a piece of land in a nice subdivision that has a lot of restrictions. The real estate broker that is listing the land accepted our offer only if we use a particular builder. Can they legally adjust the price or decline an offer, due to the builder we choose if they meet all the restrictions?

Yes,as long as the decision is not motivated by race religion, gender or handicap
