I have a 12 month rental lease that is up in march 2008. I also have a written legal agreement that the home owner will sell me the house once at last a 12 month lease is done. We just found out the house is in foreclosure and the landlord has not been using our money to pay the mortgage. What type of rights do I have and what can we do? By the time our lease is up, the house may already have gone to Sheriff's auction. We cannot purchase the house until after the 12 months and was very upfront with the landlord about the time frame needed in which to purchase. Please help. Also the landlord did not notify us of the foreclosure or that he wasnt paying the mortgage. We found out by mail and did our own research.

You have several courses of action, some because of the poor real estate market. You can ask the court for permission to pay the rent into the court for distribution to the lender. You may want to terminate the lease based on potential breach by the landlord in providing to you undisturbed possession during your lease term You may also want to discuss other options with the lender if you are in a position to buy the house. You need to contact a real estate attorney in your area to discuss all your options.
