Legal Question in Real Estate Law in Ohio

Realistate

The couple next door passed away years ago. Their family want to wave their right to the property. The house is run down and my daughter has taken care of it for years and is paying the real taxes. What form do I use to have each survivor to sign and have notorized, that will turn the property over to my adult daughter free and clear?

Re: Realistate

It depends on whose name thate property is in. If it is still in the couple's name then a probate administration will be necessary.

I would consult with a probate attorney who can assist you.

Re: Realistate

Dear Inquirer: Becaue the transfer of real estate requires absolute accuracy to avoid future challenges and problems, I would recommend use of the services of an Attorney to include all of the potential heirs of the deceased. Warranty Deeds are the recommended form, with total release of Dower by the spouses of the heirs. Contact an experienced real estate Attorney to assist and guide you through this "minefield" and obtain clear, unchallenged title for all of your Daughter's monetary contributions, etc. Good luck!

Sincerely,

J. Norman Stark
