Legal Question in Real Estate Law in Ohio

I recently received a mandate addressed to my deceased parents stating that the septic tank had to be pumped out and filled in and they must tie in to the existing sewage system within 90 days.

I reside in the family home, but I am unemployed and have no resources to finance this work. My name does not appear on the title to the home. The house is paid for and the house and property taxes have been kept current.

What are my options in this situation?

Dear Oldtimer: From one Oldtimer to another - You have the right to challenge the Sewer District's order to connect to the sewer system. If the basis for the district's Order is based upon a test they conducted of your septric tank outflow or effluent, you have the right to challenge their test and finding. You can insist on a re-test, ater you've had the system and septic tank cleaned of accumulated solids, etc. by an outside contractor.

Importantly, you have rights, and it is striongly urged that you retain experienced Cunsel to represent you and to challengethis unreasonable order.

Unfortunately there's a lot more information you should have, but space and time here are prohibited, and limited. Contact legal counsel ASAP.

Good luck.

Sincerely,

J. Norman Stark
