rent deposit

we lived in house for 12 years. The lease said no pets. My exlandlord said he wont give deposit back because we broke lease for having pets. He lived next door all this time and knew we had pets. He did not tell us to move or get rid of pets. Can he keep deposit?

Re: rent deposit

He can keep the deposit only to the extent of actual damage caused by you or your pet. After 12 years, there is a lot of ordinary wear from use for which you can't be charged.

You can recover double damages for any part of your deposit wrongfully withheld.
