Legal Question in Real Estate Law in Ohio

Shared property rights

Hello. We share a main driveway and also lake rights with our neighbors in back of us. We are both responsible for the main driveway maintenance as stipulated in the deed.

My husband is the only one snow plowing this section.. and that is fine with us.. The problem is our neighbor called and left a message on our ans. machine - ''could we please not plow down to the blacktop, leave some snow on because and I quote ''they snowmobile and can't snowmbile if it is plowed too clean. My question, do they have the right to snowmobile on a shared driveway, do we have to abide by their wishes?? and what is our recourse?

Please advise.

Thank you!!!

Re: Shared property rights

If you have no other agreement than what is contained in the deed, and the deed does not go into detail, then you really have to just work it out with your neighbor. Although you don't have to abide by their wishes, I would suggest you try to come to an amicable resolution. If they snowmobile, it seems like running them next to the driveway would work. Or maybe you decide to plow just one lane. They do have the right to use the driveway for however they decide to pass over it; walk, run, bike, snowmobile, drive, etc.
