Sold my house, let peoplein, now closing is off because of their dealings in flo
I thought everything was settled. Moved into my old house on 12-17-03 and closing was suppose to be done on the 19th. I'm still waiting and they are in my old house still and I had to start making house payments on new place since I can't pay it off because they haven't paid me yet. My realtor is now making them get a loan here in ohio since theirs in Florida fell through. They say should be 2 weeks now. Can I fire my realtor and get people out?

Here is how it works.
You will need to provide a proper 3 days notice to the tenant, assuming they haven't paid rent.
YOu then need to file a proper eviction suit in the local municipal or county court. After the eviction hearing, approximatey 2-3 weeks later, the tenant will have 10 days to move. If they don't, you will need to make arrangements with local law enforment to enforce the Courts orders.
I would recommend that you hire a local attorney for the eviction and to determine the consequences of your firing the Realtor.
A cardinal rule in real estate is to NEVER allow your home to be occupied before closing.
