Survivor Deeds

A friend recently passed away leaving no will, but her home is titled as a survivor deed to her eldest son. Problem she was married at the time of her death, her husband is not on the deed, does the husband have a legal right to the property?

The husband should consult with an attorney to determine his rights in this particular situation.

Generally surviving spouse's do not have rights in property that is left to a surviving owner, but the law treats real property differently and he may have some rights.
