Legal Question in Real Estate Law in Ohio

Water Problems

We sold our home in 1999 in Ohio and moved to Florida. The new owner is suing us saying that we knew there was a problem in the basement. We lived there 19 years and never had any problems. They want us to come back to Ohio and give them our depositions. Can the court require us to appear in Ohio for depositions? Does he have to come to Florida and file suit or can he file it in Ohio as he has done?

Re: Water Problems

Suit in Ohio may be filed in one of three different places, the county where the plaintiffs reside, where the defendants reside, or where the cause of action arose. They obviously filed where the house is located. The court can order you to appear for deposition, and also has the power to hold you in contempt for failure to appear.
