Legal Question in Real Estate Law in Ohio

I wrote a check for a hold on an apartment. I did not sign a lease and becasue of a family emergency I could not take the apartment. The people I wrote the check to cashed the check and spent the money. Do I have the right to ask for my money back?

It depends on whether it was a refundable or non-refundable deposit. If it was refundable, then yes.
