Legal Question in Sexual Harassment in Ohio
I'm having problems at work - another employee made sexual advances to me and was turned down. He tried to kiss me - he pulled me towards him and went in for a kiss. I said no, he said all I wanted was a little kiss. I was freaked out. He said - I guess i better go and left. Since then I feel as if he is stalking me - he's coming in the weight room (where I take my breaks) at the same time I'm in there. (Our breaks not on set schedule's- he can go any time and he comes in allot while I'm in there) Its really creepy! I finally reported it to HR - its to weird. They are investigating - but today, I was read his statement - its so untrue and has some things in it that will sink the whole department - he even stated that I'm making this up to retaliate because hes not interested in me. whewwww - I never saw that ball of lies coming. What can I do now - what if it gets swept under the rug? do i just have to put up with this and never use the work out room again. what are my rights? What if he's turned this around and now they believe his story. I'm at a loss and need advice. Please help.

Continue to document all the occassions. If you can get him on video or audio with your phone. Keep reporting to HR so that there is a paper trail of evidence. Ultimately, let's hope the situation resolves naturally but if it doesn't, then a lawsuit is possible. But the strength of your potential lawsuit will depend on how much evidence you can collect and how involved HR and your employer is. If your situation continues to worsen, and your employer knows about it in detail and doesn't do anything, then you may have a case.
