What is the statute of limitations for the state of ohio to take action against an out of state resident for not filing a personal income tax return?

The general rule is that the statute of limitations does not run for unfiled income tax returns. Some additional facts need to be developed and carefully evaluated to properly assess the tax/legal options and the most appropriate strategy available under Federal and State tax law.
