Legal Question in Traffic Law in Ohio

4th degree assault

my brother was driving and a cop jumped in front of him no lights were on on the cruiser so he didn't see him and it was dark. my brother swerved to miss him but he kept going because he had no license he ended up putting his car in a ditch they charged him with 4th degree felony assualt even though he didn't harm or hit anyone. got him on 12 point suspension, unsafe vehicle, and fictitious registration. our biggest concern is the assualt. how long could he be looking at for this. when it didn't actually assualt anyone.

Re: 4th degree assault

Your brother cannot take a felony here. HE needs a lawyer right now - appointed or hired...

but he needs help now. Prison for this offense is 1 1/2 years... It doesnt sound like he's guilty of this and needs to defend himself.

He can get up to 18 months in prison for a fourth degree felony. What county did this take place in?
