Accident - uninsured motorist & no citation

I was in a fender bender - I was in the lane close to curb & the car next to me decided to make a turn down an alley road cutting me off. The car lucky got stuck in traffic & I was able to talk to driver & get them to pull over and wait for Police to come (we got their license plates). The Police showed after 2 phone calls & an hour wait to only exchange our information and tell us to go to the nearest police station and fill out an accident report. The police officer on-site & at station never asked either of us for insurance. I exchanged our information before the cops arrived to find out their insurance card expired 10 days ago. After talking to my insurance company he informed the driver did not have insurance and they are not sure if the owner of the car had renewed insurance. My question is when will a citation be made? Should the cops have checked insurance at scene? Is the driver of a car covered under the owner of the car insurance? What should I do inorder to have our car fixed without having this cost/claim go against my insurance?

There was a mistake. Generally the police check for insurance. If the driver is not covered, it leads to a 90 day license suspension. Your insurance company should help you without it effecting your insurance, you weren't at fault. Best Regards, Edward DiCato
