Legal Question in Traffic Law in Ohio
child restraint violation
I recently received a citation at a checkpoint for a child restraint violation when my 4 year old daughter did not have on her seatbelt in the back seat. Everything I've read refers to children UNDER 4 years of age - my daughter is almost 5. Did I recive the correct citation or should I challenge it?

Re: child restraint violation
Your child must be 4 years old AND 40 or more pounds to avoid having to use a child restraint system. Also, any child between 4 and 16 years old must be at least wearing a seat belt. Both offenses are under the same statute, ORC 4511.81.
