In Ohio, a DUS is a misdemeanor 1 which is punishable by up 180 days in jail, $1000 fine and court costs. Sentences rarely reach the maximum. However, since your husband already knows the drill, the judge will likely not be kind. Your husband needs to work quickly on getting valid to show the judge that he is now going to follow the law. Otherwise, I see more jail time in his future.
Also, hiring a lawyer experienced in the municipal courts will be very helpful.
