Legal Question in Traffic Law in Ohio

Intersection accident, who's fault?

here is a quick synopsis,

I was turning left (north) onto a 6 lane rd. with a green left turn arrow behind a truck. Light turned yellow as I was in the middle of interection behind the truck. A car heading south on the 6 lane rd says he had a green turn light to head left (east). The hit me on my front diver side with over $3000 in damaged. The key here is that I was allready past the middle of the road that I was turning on. I was past the yellow line. It seems like his turn was to sharp. He says he a had a green turn light which IS possible if the yellow light was short. Says he never saw me behind the truck.

here is a picture I drew and put up on my website. These were the locations of the cars. i did the best I could. Im the red car. Does it mean anything that I was allready on the right side of the north/south bound rd.

Any suggestions would be greatly appreciated! Help a fellow student out.

Re: Intersection accident, who's fault?

I predict that If he says he never saw you and that is believable, you lose...But if he did see you, he had an obligation to avoid you. But since you were in an improper place, you are at first liable. He would then have the obligation to avoid you only if he saw you first.

It's a close call, but mostly reliant on his credibility.
