notification of suspended license

my mother was just arrested for driving under suspension. this is her second offense because the first offense was in result to no financial responsibility after an accident. the problem is, she didnt recieve any notification that her license had been suspended. this has actually happened two previous times (the second the judge threw it out, because it was a mistake on the bmv's part, and she was not actually driving under suspension.) this time, we don't know yet, becasue her court date is not until tuesday. she has since the first offense obtained and kept financial responsibility, therefore there should be no reason for her to be DUS again. we do not know if this third charge is a mistake or if she was indeed dus, but i am wondering if the bmv can legally not notify her of her license being suspended, and also if this is indeed a mistake again, can we do anything about them making her go to court again? thank you if you have time to answer my question.
