Red Light

I was recented cited for running a red light. I was travelling at the speed limit and had my vehicle under control. Conditions were dusk, and cloudy.

The light was yellow as it passed beyond my roofline (Does this matter if I was not completely through the intersection before it turned red?).

I had moved from Vermont to Ohio within the past week and in Vermont this time of year, a wet road (which it was) can easily be an icy road. I continued through the yellow light from force of habit, in order to avoid a possible accident from slamming on my brakes, and possibly losing control. (Extenuating circumstances? Avoidance of possible accident?)

I don't know where the officer was at the time, but if he had been travelling behind me, he also may have mis-seen my location due to low visibility.

Irrelevant info : small town, known for targeting out-of-state plates for $$$. ;-)

The fine is only $122, but I'd rather not get the points immediately upon moving.

Initially you should pled not guilty, you will be given a pre-trial date. At that time talk to the prosecutor who will have the authority to drop the points. If you don't like any deal he offers you can take it to trial. It would take a few minutes ( you don't get a jury) and you would probably be found guilty, but it is worth trying... probably.
