Legal Question in Traffic Law in Ohio

wrecked borrowed car-minor no license

My son let a classmate borrow car. The car is registered to my husband, but son drives it. The classmate took down electricity pole with the car....said dogs ran in front of him, this is a 25mph area, the pole was laid out across the street! Come to find out the classmate has NO license or even a permit. This kid is a junior in high school. There were definate tracks that showed this kid was joy riding with my sons car. Is this child responsible for the loss of the car? The mother says she is not responsible....but it is her kid! My son has been 18 for only 2 1/2 months, he was sited with ''unlawful entrustment''. What should we expect to happen at court? Should we hire an attorney? When this kid goes to his court date, will he be held responsible? Thanks for your time in this matter!

Yes, I do recommend that you speak with an attorney prior to going to court. There are certain situations that a person can be charged with Unlawful Entrustment, but be sure that this is one of them prior to going to court. Additionally, you need to know if the other boy will plead guilty and then testify against your son in return for a deal from the Prosecutor.
