Our annuities that are POD considered part of the estate that the lawyers fees are paid off of?

Annuity payouts are not included in probate assets. An executor can take a fee which is a percentage of the probate assets Attorney's fees are separate from this and are normally based upon the work performed in administering an entire estate, but not necessarily on a percentage basis.
