Legal Question in Wills and Trusts in Ohio

Bank Account for Deceased

My sister died 12/23/06 with a will naming me as executrix.

Should I, could I, establish a bank account in the name of her estate?

Her husband died 06/30/06. Is her estate liable for any unpaid bills from her husband (medical or otherwise)?

Do I ''file'' tax returns for her and/or her husband? Both were retired.

Thank you.

Re: Bank Account for Deceased

You can, and should, open an account in the name of the estate as soon as the court appoints you AND you obtain a federal ID number for the estate. As to the husband's debts, without knowing what the husband's assets were, and who he owed, that question cannot be answered.

Re: Bank Account for Deceased

I suggest first setting up the administration of the estate by filing an application to administer the estate with probate court. This will then lead you to the next step of opening a bank account. Probate administration is a step-by-step process, and you could benefit from guidance as you go through it. It is not possible to say without reviewing each claim whether your brother-in-law's creditors will file a claim against the estate that remained with your sister.
