Legal Question in Wills and Trusts in Ohio

Beneficary of wills

My husband and i each have wills. We have named each other as primary beneficarys.

However, if our spouse as not survived the estate is distributed differently on each will. If we should both die at the same time, how would estate be settled. Who's will would be used?

Re: Beneficary of wills

It depends on the wording of the wills. Does either will require the other to survive by a certain time? If not, in case of a simultaneous death, each of you would be treated as if you had survived the other, and distribution made accordingly.
