Legal Question in Wills and Trusts in Ohio

my brother is in the hospital very sick. He has no will. I am his sister the closest one to him. his sons and daughter have not been around for years. He wants me to distribute his assets accordingly, but has no will. What should he do?

I am sorry to hear about your brother. IHe should discuss this matter with an Estate Planning attorney ASAP so that the situation can be properly evaluated. If he is competent, he can execute a will and document how he would like his estate distributed and can appoint you as his exeutrix. Without a will, the laws of descent and distribution will dictate who will inherit, which will be his children and you may not be appointed to represent his estate.
