Legal Question in Wills and Trusts in Ohio

My brother was murdered in January and had no Will or Estate set up. He has a 2 year old son who lives with his Ex-Wife. The victim assistance is issuing a large sum check to my nephew. Will this go into a trust for him or will his mom get it?
