Legal Question in Wills and Trusts in Ohio
Death in the family
My father recently passed away,I havent been able to find a Will,I thought he had 1;He was in OH Im in AZ.When I was there I went through his paperwork but I know I havent found record of all bank accounts, ins.policies etc. but I believe my step sister has the paperwork she just isnt saying so,they lived in the same house. She is trying to tell everyone she is his next of kin when she isnt a blood relative,& managed to fill out my dads life ins. policyputting herself as the primary beneficiary and then my sister and myself.(My Dad just recently added her to the policy but not as primary)My father didnt have much but I know he had more than I found,is there any way possible to somehow find out if he has a Will? Also is there any way of finding out if he had any other accounts, policies,or maybe a safe deposit box somewhere? His wishes were for everything to be split 3 ways, but I have a feeling my step sister intends to keep whatever he did have for herself. Please help,I cant afford to hire any attorney right now and I just want what my father wanted.Thank You.

Re: Death in the family
Either you or your sister can file papers with the Probate Court asking to be appointed administrator of your dad's estate. After the court appoints you, you will have the authority to ask for information about any assets that dad may have had. You would also have the authority to question your step sister regarding any of your dad's assets that she is keeping. You will not be able to get much information without being appointed by the Court.
If you want more information on what you will need, feel free to give me a call. There are a number of factors that may effect what you are able to do and I will need to discuss those with you. No Charge or obligation for the confidential telephone call.
Good Luck!
